Monitoring Mechanism under the JJ Act, 2000
Monitoring Mechanism established under the Juvenile Justice (Care and Protection of Children) Act, 2000 in Delhi.

  • District wise Inspection Teams under Section 35 of the JJ Act, 2000 have been notified. These teams are mandated to undertake regular visits to Children Homes for review of the Standards of Care & Protection being followed by the Institutions falling in their respective districts. Apart from this the Children Homes are regularly inspected by the Child Welfare Committees (CWCs) as well. 
  • Under Section 62 of the JJ Act, 2000, the Department has notified State Advisory Board for advising the Government on matters relating to the establishment and maintenance of Homes, mobilization of resources, provision of facilities for education, training and rehabilitation of children in need of care and protection and juveniles in conflict with law. 
  • The Delhi Government has constituted the ‘Delhi Commission for Protection of Child Rights’ (DCPCR) on 08.09.2008 in accordance with Section 17 of the Commissions for Protection of Child Rights Act, 2005. DCPCR works on issues related to education, child health, child development, juvenile justice, care of neglected/ marginalized children, children with disabilities, children in distress, child psychology and laws relating to children. 
  • The State Govt. has also framed Rules to carry out the provisions of Commissions for Protection of Child Rights Act, 2005 on the basis of model rules framed by Government of India and necessary notification has already been issued in this regard. 
  • The Department has also notified the Courts of Additional Session Judge - One at each Police district as Children’s Court for the trial of offenses against children or of violation of child rights under section 25 of the Commissions for Protection of Child Rights Act, 2005 and section 28(1) of Protection of Children from Sexual Offences Act, 2012. 
  • The Department of WCD in collaboration with Govt. of India is in the process of uploading of Data of found children who are housed in the state government run Children Homes on the National Web Portal (http//: www.trackthemissingchild.gov.in/trackchild) developed by NIC. This portal is linked with Zip.net, a website of Delhi Police. This Data shall facilitate the tracking and restoration of children. 
  • The Department of WCD, Govt. of NCT of Delhi has framed Delhi Juvenile Justice (Care & Protection of Children) Rules, 2009 u/s 68 which were notified vide notification no. 61 (9)/JJ Amend. Act/AD-I/DWCD/2009/25362-391, dated, 24.09.2009. 

  • After the Implementation of Integrated Child Protection Scheme, the department has set up the following units: 
    • State Child Protection Society, 
    • 2 District Child Protection Units, 
    • State Project Support Unit, 
    • State Adoption Resource Agency, 

    • Adoption Recommendation Committee - which scrutinizes the documents of the children proposed for inter-country adoption. 

  • The Deptt. of WCD has developed Standard Operating Procedures for Child Welfare Committees for handling the cases of victims of sexual abuse, trafficking of children for commercial sexual exploitation, General Procedures, and to get a child declared legally free for adoption. 
  • The Department, WCD has also developed following SOPs 
    • For Visitors- Non-official /staff. 
    • For Visit of family members of juveniles. 

    • Rule 94 of Delhi Juvenile Justice (Care & Protection of Children) Rules-2009. 

  • The Protection of Children from Sexual Offences (POCSO) Act, 2012 came into force on 09.11.2012. This new legislation provides protection to all children under 18 years of age from offences of sexual assault, sexual harassment, pornography and offers child friendly procedures for recording of evidence, investigation and trial. The Children Courts already set up would also try all cases registered under the POCSO Act.
